Terms of Use

1. Agreement and Apple terms

By using Omily Speak you enter into an agreement with OMILY LABS LTD, the operator of Omily Speak, and agree to these terms. For the iOS app, Apple’s Standard End User License Agreement also applies and is incorporated into these terms. If there is a conflict about the iOS licence, Apple’s standard agreement controls.

2. Learning service

Omily Speak provides AI-assisted language practice, feedback, and learning tools. AI responses can be incomplete or wrong and are not professional, legal, medical, immigration, examination, or certification advice. You remain responsible for how you use suggestions and for checking important information.

3. Accounts and acceptable use

Keep your Apple account and device secure and do not share, sell, automate, reverse engineer, overload, scrape, or misuse Omily Speak. Do not submit unlawful, abusive, infringing, dangerous, or privacy-invasive content. We may restrict or suspend access where reasonably necessary to protect users, providers, or the service.

4. Free access, trials, and Premium allowances

• Free access includes 2 live-AI speaking sessions of up to 5 minutes each per calendar month.
• An eligible 7-day trial includes one 120-minute Premium allowance for the trial window rather than a smaller trial-only allowance.
• Premium includes 120 live-AI speaking minutes per monthly allowance period, one active live session at a time, sessions of up to 30 minutes, and up to 4 call starts per day. The reset date shown in the app applies even when an annual subscription is paid upfront.
• All live speaking modes share the allowance. Unused time does not roll over and Omily Speak does not charge usage overages.

We may apply proportionate technical safeguards against fraud, automation, credential reuse, and unreasonable load. We may increase allowances, and will give reasonable notice before a material reduction that affects an active paid period where required by law.

5. Apple subscriptions and cancellation

Prices, billing dates, trial eligibility, taxes, and renewal terms are shown by Apple before you confirm a purchase. Trials convert automatically unless cancelled before the trial ends. The flexible monthly plan renews until cancelled. An annual plan may be paid upfront or, where Apple offers it, through 12 monthly payments with a 12-month commitment. Cancelling renewal of a commitment plan may not remove the obligation to make remaining payments; Apple’s purchase sheet and regional rules control. Manage cancellation and refund requests through Apple. Deleting your Omily Speak account does not cancel your Apple subscription.

6. Availability and liability

We aim to keep Omily Speak reliable but do not guarantee uninterrupted access or a particular learning result. To the fullest extent allowed by law, we are not liable for indirect or consequential loss. Nothing in these terms excludes rights or liability that cannot lawfully be excluded, including applicable consumer rights.

7. Changes and contact

We may update these terms as the service changes. Material changes will apply prospectively and will be communicated where required. Questions can be submitted on our support page.
